What a cash sale settles at the closing table
- The unpaid principal balance and the interest accrued through the payoff date.
- The past due payments, late fees and any advances the servicer made for taxes or insurance.
- Any second mortgage, home equity line or other lien recorded against the property.
- Closing costs, including Florida documentary stamp tax on the deed.
- Whatever is left after all of that is yours to keep.
After that window closes, Florida is a judicial foreclosure state, so the lender has to file a case in circuit court. That takes time as well, but by then the decisions stop being yours and start being the court's.
Meanwhile the number grows. Late fees, accrued interest and any escrow shortage get added to what you owe, and the missed payments are reported to the credit bureaus while you decide what to do.
