A final judgment or a signed settlement agreement tells the title company how to disburse the money. What it does not do is rewrite your loan. If both names are on the note, the lender can still look to both of you until that mortgage is paid off at closing or refinanced out.

Timing can matter on taxes too. A couple still filing jointly may exclude up to $500,000 of gain on a qualifying primary residence, while a single filer is limited to $250,000. That is a question for a CPA and your attorney, not for us.
