Florida also has the enhanced life estate deed, usually called a lady bird deed. Florida has no transfer on death deed for real property, so this is the common tool: the owner keeps full control during life, and at death title passes to the named remainder beneficiaries outside probate.

Blended families hit a rule worth knowing early. Under the Florida Constitution, homestead is not subject to devise if the owner is survived by a spouse or a minor child, though it may be devised to the spouse when there is no minor child. Second marriages with children from a first marriage are where that bites.

One more piece of housekeeping: the homestead exemption follows a permanent residence. An owner who does not file annually must notify the property appraiser promptly when the use of the property or the owner's status changes, and leaving an exemption on a house that is no longer someone's home can mean back taxes for up to 10 years plus a 50 percent penalty and 15 percent interest.
