Understanding Low Equity When You Sell in Florida
Equity is what is left after everything secured against the house is paid. Low equity means the loan payoff and the cost of selling take most of the price, and sometimes all of it.
Start with the payoff letter, not the balance on your statement. A payoff includes interest accrued to a stated date, a per diem after that, and any escrow shortage or fees the servicer advanced, so it usually runs higher than you expect.
The math that decides a low equity sale
- The real sale price, not a listing price you hope someone pays.
- Minus the mortgage payoff, including accrued interest, per diem and any escrow shortage.
- Minus other recorded liens: a second mortgage, HOA dues, judgments, code fines, unpaid taxes.
- Minus closing costs: documentary stamps at 70 cents per $100, title work, recording, prorations.
- Minus commission if you list, which is negotiable but rarely small.
- What is left is your proceeds, and with low equity that number can land at zero.
If the payoff is more than the house is worth
- Bring the difference to closing in cash, if you have it.
- Ask the servicer to approve a short sale, which means they accept less than the payoff and sign off on the price.
- Get any deficiency waiver in writing, because the unpaid balance does not disappear on its own.
- Ask your servicer what else you qualify for, and use a HUD approved housing counselor, which is free through consumerfinance.gov/mortgagehelp.
- Talk to a Florida attorney or CPA before you sign, because forgiven debt can carry tax consequences.
Then subtract the cost of transferring the house. Florida charges documentary stamp tax on the deed at 70 cents per $100 of the price in every county except Miami-Dade, and title insurance, recording fees and prorated taxes come on top. Who pays which line is negotiable and varies by local custom.
On a listed sale, commission is usually the largest single line. Since the August 2024 industry changes, compensation is negotiable and not set by law, and offers of buyer agent compensation are no longer published on the MLS, but whatever you agree to still comes out of the same thin slice.
