Understanding a Sale With a Tenant in the House

The first thing worth knowing is that selling does not end the lease. A written lease runs with the property, so a buyer steps into your place as landlord and the tenant keeps the term they signed.
Where landlords usually land when a tenancy goes bad

What to have ready when you call us

Deposits go with it. Florida Statutes section 83.49(7) requires security deposits and advance rent to be handed to the new owner along with an accurate accounting of what belongs to each tenant, and the new owner picks up that obligation.
If the tenancy has no fixed term, Florida sets the notice. Since the 2023 amendment to section 83.57, ending a month to month tenancy takes at least 30 days notice before the end of a monthly period, and a week to week tenancy takes 7 days.
The eviction notices people usually ask about live in section 83.56. Nonpayment starts with a 3 day notice to pay or vacate, counting only business days, and other lease violations generally use a 7 day notice to cure or a 7 day notice to vacate. Actual eviction is a court case, and a Florida landlord tenant attorney is worth the hour.
What you cannot do is handle it yourself. Section 83.67 forbids shutting off utilities, changing locks or removing doors to force a tenant out, and a landlord who does can owe actual damages or three months' rent, whichever is greater, plus attorney's fees.

Anything that has turned the rental into work you did not sign up for. Late or partial rent, a lease violation you keep re serving notice on, damage you find out about after the fact, or a tenant who has simply stopped answering. The property may be fine. The tenancy is what has gone wrong.
How Fast Can You Buy an Occupied Rental?
